The Service may be delivered through our website, mobile experiences, Telegram bot, Telegram Mini App, developer/API features, and related integrations. These Terms apply to all supported access points unless we expressly state otherwise in writing.
You must be at least 13 years old to use the Service. If you are under 18, you must have parental or guardian consent. By using the Service, you represent that you meet these requirements and have the legal capacity to enter into a binding agreement.
To access certain features, you must create an account. You agree to provide accurate, current, and complete information and to update it as needed. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use. We may offer different account roles or internal access levels for operational and administrative purposes.
If you connect Telegram, you authorize us to associate your Telegram account, chat, and related thread or Mini App session identifiers with your Esaart account for authentication, routing, support, operational, and notification purposes.
You are responsible for keeping your account secure and for any activity that occurs through your account, linked Telegram account, API keys, or other connected access points.
The Service uses a credit-based system. Credits are consumed when you generate images, videos, audio, workflow outputs, template runs, chat turns, or other eligible AI tasks. We may offer free credits, subscriptions, one-time purchases, promotional credits, rewards, or administrative adjustments. Paid credits and subscriptions are non-refundable except as required by law, platform rules, or a written policy that applies to the purchase. Abuse prevention controls may affect available balances. We reserve the right to change pricing, packages, model availability, and credit costs with reasonable notice where required.
Depending on platform, region, and feature availability, purchases may be processed through app store billing, web payment providers, or Telegram Stars. The available purchase methods, package prices, taxes, fees, currency, and final settlement amount may differ by platform. A package with the same logical credit value may be offered through different payment rails at different prices or under different platform rules.
Credit estimates shown in the Telegram bot or Mini App are informational previews. Final credit usage may depend on the model, parameters, provider behavior, retries, moderation, safety checks, and the generation workflow actually executed.
If you purchase credits through Telegram Stars, you agree that the transaction is also subject to Telegram's payment, wallet, platform, and digital goods rules. We may reject, delay, reverse, or withhold crediting where a payment event is invalid, duplicated, inconsistent with the invoice payload, linked to an unlinked or unauthorized account, or otherwise appears fraudulent, abusive, or technically incomplete.
Credits have no cash value, are not legal tender, and may not be transferred, resold, or exchanged except through functionality we expressly provide. We may correct balances or reverse transactions to address fraud, chargebacks, refunds, duplicate provider events, technical errors, or policy violations.
You retain ownership of content you upload (e.g., reference images, prompts). By submitting content, you grant us a limited license to process it for providing the Service, including storing, transmitting, modifying, displaying, and generating outputs as needed to operate requested features, support public sharing, provide support, enforce policies, and maintain safety and reliability. We do not claim ownership of your inputs or outputs, except for rights needed to operate the Service and enforce these Terms.
You represent that you have all rights, licenses, consents, and permissions needed for the prompts, images, audio, video, files, likenesses, voices, names, trademarks, and other materials you submit.
Content generated by AI models ("Outputs") is provided for your personal or commercial use, subject to these Terms and our Acceptable Use policy. You are responsible for ensuring your use of Outputs complies with applicable laws. We do not guarantee that Outputs are accurate, unique, available, suitable for your intended use, or free from third-party rights. Some models may have additional licensing terms, content policies, or provider-specific restrictions.
Similar prompts, seeds, models, templates, or workflows may produce similar or identical outputs for different users. You are responsible for reviewing Outputs before publishing, selling, relying on, or using them in regulated, sensitive, or high-impact contexts.
Some features let you make generations, templates, comments, profile details, prompts, or related metadata public. If you choose to publish or share content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, promote, and otherwise make that public content available in connection with the Service.
You are responsible for public content you share. Removing or making content private may not remove copies already viewed, copied, downloaded, indexed, screenshotted, or shared by others.
If you submit templates, flows, prompts, examples, or other creator content for public listing, we may review, approve, reject, modify, categorize, feature, remove, or demote that content to protect users, comply with law, preserve quality, or operate the Service. Approval does not mean we endorse the content or guarantee future availability.
Creator earnings, revenue share, rewards, or credits are subject to current product rules, eligibility, fraud review, and technical availability. We may adjust or withhold earnings where activity is fraudulent, abusive, policy-violating, refunded, reversed, or technically invalid.
The Service depends on third-party platforms and providers, including authentication, hosting, storage, AI model providers, payment processors, analytics, diagnostics, email, app stores, and Telegram. Your use of those features may also be subject to third-party terms, policies, fees, restrictions, outages, and account requirements.
We are not responsible for third-party services we do not control, but we may change, suspend, replace, or remove integrations as needed.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not use the Service to generate content that infringes intellectual property rights, violates privacy, or is harmful, misleading, or illegal. You must comply with all applicable laws and our content policies. We may use automated systems and manual review to detect abuse, enforce these Terms, protect other users, and maintain the integrity of the Service.
This includes misuse of Telegram-based features such as automated spam, abusive bot interactions, evasion of rate limits, attempts to break account-linking flows, or use of threads, commands, Mini App screens, Telegram Stars billing flows, or payment callbacks in a way that interferes with other users or our systems or infrastructure.

We may suspend or terminate your access at any time for violation of these Terms or for any other reason. We may also block accounts, limit features, revoke credits, remove content, or process administrative deletion where needed for policy enforcement, fraud prevention, security, legal compliance, or operational integrity. You may close your account at any time, and in some cases account deletion may be subject to a short pending period before final processing. Upon termination, your right to use the Service ceases. Provisions that by their nature should survive (e.g., ownership, disclaimers, indemnification) will survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. AI-GENERATED CONTENT MAY CONTAIN INACCURACIES, OMISSIONS, BIASES, OR UNEXPECTED RESULTS. USE OF THE SERVICE AND ANY OUTPUTS IS AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
You agree to indemnify and hold harmless Esaart, its affiliates, and their officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance. If you do not agree, you must stop using the Service.
