The Service may be delivered through our website, mobile experiences, Telegram bot, Telegram Mini App, and related integrations. These Terms apply to all supported access points unless we expressly state otherwise in writing.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you must have parental or guardian consent. By using the Service, you represent that you meet these requirements and have the legal capacity to enter into a binding agreement.

If you connect Telegram, you authorize us to associate your Telegram account, chat, and related thread or Mini App session identifiers with your Esaart account for authentication, routing, support, operational, and notification purposes.

4. Credits & Billing

The Service uses a credit-based system. Credits are consumed when you generate images, videos, or audio. We may offer free credits, subscriptions, or one-time purchases. Paid credits and subscriptions are non-refundable except as required by law or as stated in our refund policy. Administrative adjustments, promotional credits, rewards, and abuse prevention controls may affect available balances. We reserve the right to change pricing with reasonable notice.

Credit estimates shown in the Telegram bot or Mini App are informational previews. Final credit usage may depend on the model, parameters, provider behavior, retries, moderation, safety checks, and the generation workflow actually executed.

5. Content Ownership

You retain ownership of content you upload (e.g., reference images, prompts). By submitting content, you grant us a limited license to process it for providing the Service. We do not claim ownership of your inputs or outputs, except as necessary to operate and improve the Service.

6. AI-Generated Content

Content generated by our AI models ("Outputs") is provided for your personal or commercial use, subject to these Terms and our Acceptable Use policy. You are responsible for ensuring your use of Outputs complies with applicable laws. We do not guarantee that Outputs are unique or free from third-party rights. Some models may have additional licensing terms or provider-specific restrictions.

7. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not use the Service to generate content that infringes intellectual property rights, violates privacy, or is harmful, misleading, or illegal. You must comply with all applicable laws and our content policies. We may use automated systems and manual review to detect abuse, enforce these Terms, protect other users, and maintain the integrity of the Service.

This includes misuse of Telegram-based features such as automated spam, abusive bot interactions, evasion of rate limits, attempts to break account-linking flows, or use of threads, commands, or Mini App screens in a way that interferes with other users or our systems or infrastructure.

You may not:

• Generate content depicting minors in inappropriate contexts
• Create deepfakes or misleading content intended to deceive
• Infringe on trademarks, copyrights, or other intellectual property
• Circumvent security measures or abuse the Service
• Resell or redistribute the Service without authorization
• Use automated systems to access the Service beyond permitted use
• Attempt to evade account restrictions, moderation actions, or billing controls
• Misuse admin or privileged functionality, or attempt to obtain unauthorized access

9. Intellectual Property

The Service, including its design, features, and underlying technology, is owned by us or our licensors. You may not copy, modify, distribute, or create derivative works without our written permission. Our trademarks and logos may not be used without prior consent.

10. Termination

We may suspend or terminate your access at any time for violation of these Terms or for any other reason. We may also block accounts, limit features, revoke credits, remove content, or process administrative deletion where needed for policy enforcement, fraud prevention, security, legal compliance, or operational integrity. You may close your account at any time, and in some cases account deletion may be subject to a short pending period before final processing. Upon termination, your right to use the Service ceases. Provisions that by their nature should survive (e.g., ownership, disclaimers, indemnification) will survive.

AI-GENERATED CONTENT MAY CONTAIN INACCURACIES, OMISSIONS, BIASES, OR UNEXPECTED RESULTS. USE OF THE SERVICE AND ANY OUTPUTS IS AT YOUR OWN RISK.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
